PROCEDURE FOR RECRUITMENT OF WORKERS FOR EMPLOYMENT IN MALAYSIA.

Department of Bureau of Emigration Overseas Employment Pakistan had laid down following procedure for recruitment of Pakistani workers to work in Malaysia through Overseas employment Promoters ( eg Iqbal Brothers )

1- Placement of Demand by Malaysian employer

The Employer shall submit an application to Ministry of Home Affairs (MOHA/KHEDN)/ Labour Department Sarawak (LDS)/Immigration Department Malaysia, Sabah ,(IDM) Sabah), as the case may be to obtain Permission /Approval Letter to employ foreign workers.

ii)

MOHA (KHEDN)/LDS/IDM Sabah shall process application and issue Approval letter to the Employer.

iii)

The Employer shall prepare a set of following documents in English and submit it in
Community Welfare and Labour Section of the High Commission for Pakistan, kuala
Lampur for endorsement/attestation.

a)	Appointment Letter/Power of Attorney by the Employer in the name of Licenced Overseas Employment Promoter (click to view).
b)	Demand Letter addressed to Licensed Overseas Employment Promoter (click to view ).
c)	Employment Contract between employer and Worker.
d)	Affidavit by the Employer

2- Verification of Community Welfare Attach
The Following Additional/Supporting documents shall be enclosed with the application by the Employer:

a)	Covering Letter for High Commission for Pakistan, Kuala Lampur
b)	Covering Letter for Malaysian Mission in Pakistan, Islamabad/Karachi.
c)	A copy of Approval Letter issued by MOHA Malaysia (KHEDN)/ID Sarawak/IDM Sabah, along with duly certified English translation (original approval letter will be seen and returned to the employer).
d)	Company Information/Certificate as maintained Companies Commission of Malaysia or any other relevant authority.
e)	Company Profile (with full contact information including e mail and website address).
Community Welfare Attaché shall attest the Demand Letter and Power of Attorney after verification of job availability and financial soundness of the Employer within two days from the date of submission of documents under intimation to this Bureau simultaneously.

3- Procedure for grant of permission
Dept of Protector of Emigrants in Pakistan shall, on receipt of demand documents, grant permission after obtaining approval of the Bureau.

4- Advertisement of Demands
The Overseas Employment Promoter in Pakistan ( Iqbal Brothers ) shall advertise invariably the demand in leading national Urdu newspapers as per attached advertisement format.

5- Selection of Workers
The Employer shall recruit workers of choice himself or his authorized representative or by
the Overseas Employment Promoter on the criteria RIGHT MAN for RIGHT JOB.

6- Security Clearance
A selected worker shall himself obtain police character verification certificate from District Police Officer (DPO) of District of residence for the purpose of endorsement of visa and recruitment
Of Malaysian Government workers shall be responsible for its genuineness.

7- Medical Examination Test
The Selected workers shall arrange himself his medical certificate from following medical centers accredited by the Ministry of health Malaysia and High Commissioner in Islamabad:

i)	Taj Medical Complex Ltd M.A Jinnah Road , Karachi
ii)	Taj Medical Centre, 2-4-A Sehat Centre, Crowne Plaza
iii)	Businessman Hospital (Shalimar), Shalimar Link Road, Lahore.
iv)	Taj Medical Centre, ll A, Wahdat Road, near Allied Bank, Lahore
v)	Shifa International Hospital , Islamabad
vi)	Al- Hilal Medical Centre , Karachi
The Expenses for Medical Tests/examination will be borne by worker himself .On arrival in Malaysia, all workers will be re-examined medically. In case any medical certificate is found incorrect/fake the concerned worker will be repatriated back home immediately at his own risk and cost.

8- Endorsement of Visa
The Overseas Employment Promoter Shall arrange calling/entry visas through Malaysia employer duly approved by Home Department for selected persons. The High Commissions of Malaysia in Islamabad/Karachi will endorse visa on the Machine Readable Passport of intending emigrant after obtaining following documents.

a)	Application Form
b)	Visa Fee
c)	Medical Certificate from nominated medical center
d)	Character/good conduct certificate issued by DPO
e)	Company Profile (with full contact information including e mail and website address).

9- Registration of Employment contract with protector of Emigrants
The Overseas Employment Promoter shall apply for registration of employment contract of each selected worker with concerned Protector of Emigrants and shall furnish following documents.

a)	a) Machine Readable Passport of intending emigrant duly endorsed entry visa by the High Commission of Malaysia in Islamabad/Karachi.
b)	Employment contract duly filled in and signed by the employee, employer or Overseas Employment Promoter on behalf of employer.
c)	Copies of challans for deposit of Government fees, Welfare Fund in designated bank , Insurance premium etc.
d)	Copy of Police character verification certificate , issued by DPO.
e)	Medical fitness certificate
f)	A receipt of total payment made to Overseas Employment Promoter for all expenses borne by the selected worker.
g)	Copy of advertisement given in the press to verify that it is as per format.

10- Clearance/registration of female workers

i)	In case of demand for females workers, Community Attaché shall visit place of employment and verify the credential of the employer, working conditions, boarding and lodging for females workers.
ii)	A Selected lady workers will provide a NOC from her parents/guardians for her employment in Malaysia.
iii)	Affidavit of employer as per specimen.
iv)	An undertaking from the Overseas Employment Promoter concerned that the concerned employer have good reputation and will safe guard the interest of the female worker in Malaysia.
v)	Protector of Emigrants concerned shall send fortnightly repot regarding registration of female worker to Director General, BE&OE for information.

11- Pre departure briefing

The Overseas Employment Promoter shall brief the selected worker about terms and conditions of this service.

ii)

The selected worker shall appear before Dept of Protector of Emigrants who shall brief him abut terms and conditions of service.

iii)

O&B Officer shall brief the emigrants in Protector of Emigrants office. The orientation and briefing will cover the following as per modules prescribed by the Malaysian Government.

a)	Climate, social, customs, traditions, of the host country.
b)	Salient Features of the Labour Laws of the host country.
c)	Do’s and Don’ts while abroad.
d)	Voluntary willingness of the emigrants to serve abroad.
e)	Signed copy of employment shall be handed over to emigrant bearing registration number and signatures of Protector of Emigrants after briefing session.

12- Clearance/registration of female workers

i)	In case of demand foe female workers, Community Welfare Attaché will visit place of employment and verify the credential of the employer, working conditions, boarding and lodging for females workers.
ii)	A selected lady workers will provide a NOC form her parents/guardians for her employment in Malaysia.
iii)	An undertaking from the Overseas Employment Promoter concerned that the concerned employer have good reputation and will safe guard the interest of the female worker in Malaysia.
iv)	Protector of Emigrants concerned will send fortnightly repot regarding registration of female worker to Director General , BE&OE for information.

13- Departure of workers

i)	Overseas Employment Promoter shall furnish complete list of migrants proceeding to each employer alongwith flight details.
ii)	The Overseas Employments Promoter shall arrange tickets and will ensure safe departure of workers to Malaysia. Every selected worker will wear clean national dress or Trouser/shirt.
iii)	The list of departing emigrants alongwith details shall immediately be sent to Community Welfare Attach, Kulalampur, Malaysia for his information.

Pakistan, (please write name and other details) to be our true and lawful attorney I Pakistan for the purpose of handling all affairs associated with the collection of CV’s of Pakistani workers for employment, making selection of workers , etc for our company, and to sign all necessary documents and employment contracts required by the law and regulations of Pakistan and Malaysia, and to arrange for passports and necessary visa endorsement with the High Commission of Malaysia , Islamabad/Consulate General of Malaysia, Karachi and to make arrangements for the workers’ passages to the job site.

This power of attorney shall remain valid till all the workers arrive in Malaysia according to the Demand Letter No. Dated 2005

This power of attorney is non-transferable and irrevocable.
